Codes of Practice provide advice on how to comply with Work Health and Safety requirements. They are not compulsory and alternative means to achieve compliance can be followed. However, it is essential to be able to prove that the alternative means used were of an equivalent of higher standard than the Codes of Practice. Compliance and non-compliance with a Code of Practice can be used as evidence in legal proceedings.

Some of the WHS Codes of Practice have been approved by both Safe Work Australia and the Ministerial Council. However, there are still a number of Codes, which are currently being revised after the public comment period. Therefore, they are still in draft form.
