The introduction of 122 Modern Awards and the National Employment Standards (NES) on 1 January 2010 has resulted in significant challenges and changes for businesses with new coverage, hours of work, classification and wages, penalties and overtime. In addition, many businesses find the transitional provisions to phase in or phase out differences in wages and penalties confusing and complex to calculate.

However, it is essential that businesses have a solid understanding of their awards and are able to correctly apply them. Throughout 2010, the Fair Work Ombudsman will doorknock 5,000 South Australian businesses to inspect compliance with awards, record keeping and the National Employment Standards. Breaches of awards and workplace laws may result in underpayment claims and/or prosecution. The Modern Award Advisory Service and Business SA’s Modern Award seminars are a small investment to ensure compliance with the new Modern Award system.

The Modern Award Advisory Service exclusively offers Business SA members the opportunity to meet one-on-one with a highly experienced Business Advisor who will guide you through the complexities of the new award system and assist you with your questions at a fixed fee. Complementing our existing Award Service and Telephone Advisory Service, this Modern Award Advisory Service will provide your business with the essential information to help the transition into the new award system be as simple as possible.

With two options of the service available, you can choose between learning more about key components of the specific Modern Award that covers your employees or have an in-depth discussion on how a specific Modern Award will impact on your individual business.  

Commonly covered topics in a Modern Award Advisory session include:

- Part-time employees, change in hours and payment of overtime.

- How the Modern Award interact with the National Employment Standards.

- Reclassification of employees, payment of wages and allowances.

Business SA also offers two training sessions to assist businesses in managing the implementation of Modern Awards.

The Modern Awards session provides a comprehensive overview of the Modern Award system, including industry and occupational coverage, part-time employees and overtime, casual conversion and award-flexibility.

The Transitional Provisions Session explains how to phase in and phase out wages and penalties, when business are required to apply them and how to apply the annual wage increase to transitional rates of pay.

In addition, a number of sessions are provided to assist businesses in complying with specific aspects of the Fair Work Act 2009, including the NES, unfair dismissals and enterprise agreements.
