What you need to know about the new Personal Property Securities Register

Personal Property SecuritiesA new national register of personal property securities (PPS) is scheduled to start in May 2011. The PPS Register will replace existing South Australian asset registers including, the Vehicle Securities Register, the Land Titles, Registry of Deeds and Crop Liens and the Registry of Co-operatives and Associations and the Commonwealth Register of Company Charges, the Australian Register of Ships, and the Fisheries Register.

Personal property listed on the Register includes assets that may be used to secure a loan, such as cars, boats, crops and intellectual property. The Register does not include real estate property, such as houses or land. The Register will be web-based, and accessible to search and register security interests 24-hours a day, seven days a week.

The new PPS Register is part of a reform that will affect the way businesses and consumers deal with secured finance in Australia. Business owners may be affected by changes to personal property security laws as:

  • buyers of properties that may be subject to a security interest
  • business borrowers or consumer borrowers
  • providers of credit; or
  • investors who are contemplating to buy into a business.

The PPS Register can also help business owners manage credit risk; check for debt owing on goods planned for purchase; and search and register assets used to secure a loan.

For more information about the changes visit www.ppsr.gov.au.
