Preventative measures for bullying, discrimination, and sexual harassment in the workplace

Poor, inappropriate and illegal behaviour can occur in any workplace, and it usually takes the form of bullying between colleagues or managers and their staff. It may also include discrimination against age, gender or race, or sexual harassment.

On Monday 28 November 2022, the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Bill 2022 was passed.

The Bill inserts a provision in the Sex Discrimination Act 1984 (Cth) which imposes a positive duty on employers and persons conducting a business or undertaking (“PCBU”) to take all reasonable steps to prevent conduct that constitutes sex discrimination, sexual harassment, subjecting a person to a hostile workplace environment, or victimisation. Importantly, the actions of employers, employees and agents will be covered by this positive duty.

Now more than ever, workplaces need to understand and ensure preventative measures are in place. This includes ensuring leaders are appropriately trained to mitigate the risk of any kind of harassment occurring and understanding how to appropriately handle a situation if it does.

Registering for the South Australian Business Chamber’s half-day Bullying, Discrimination and Harassment course for managers is one of the steps you can take to ensure you are meeting your obligations as an employer.

By providing the tools your leaders need to be able to prevent bullying, discrimination, and sexual harassment you are protecting your people, and your business.

Over four hours, our facilitators will cover all relevant laws and regulations and provide managers with an understanding of how to apply them at the operational level. The course will provide participants with the tools to identify problems, to understand the issues, and deal with them effectively.
