Business skilled visas and investor visas for individuals

Business and investor visas are specifically for people with skills in business or investment who are seeking to access the Australian business community and obtain Australian permanent residency. These visas have relaxed age criteria and applicants may opt for a direct permanent resident visa, or a temporary visa with a pathway to permanent residency.

These visas require a nomination by an Australian state or territory, or Austrade, taking into account various criteria such as business or investment background, business turnover, business ownership, net personal and business assets, and, amount of funds proposed to be invested and their benefit to Australia. The visas available under this category are:

  • Subclass 188 Business Innovation & Investment. This is a provisional visa valid for up to 5 years with the option of extension in some streams. It is based on business or financial investments and, once the committed investment is made or business plans are rolled out over the specified period, the applicants and their family members can apply for nomination from their State or Territory for a permanent resident visa.
  • Business Innovation and Investment permanent resident visa (subclass 888). This visa provides the transitional pathway to permanent residency for those Subclass 188 visa holders who have met their residency and other conditions. In this case, the applicant’s family, including spouse and dependent children, are eligible to obtain permanent residency.

General skilled visas for individuals

Australia needs migrants to meet shortages in its skilled workforce. It is one of few developed economies that emerged from the 2008 global economic crisis relatively unscathed, and it as now demonstrated itself to be an exemplar in managing COVID-19. For migrants, Australia is regarded as one of the most sought after destinations in the world, particularly with its universal free medical cover, school education and child support grants for eligible migrants.

There are three standard skilled visas under the General Skilled Migration stream:

  • Skilled independent permanent residence visa (subclass 189)
  • State or territory nominated skilled permanent residence visa (subclass 190)
  • State, territory or close family member nominated provisional skilled visa (subclass 491)

Applications are assessed against the Skilled Occupation Lists, available job roles as per ANZSCO codes, conditions of skill assessment agencies, point-score, and individual state/territory nominated occupation lists.

There is also a Global Talent (subclass 858) visa. This visa is for exceptional individuals who have excelled in one of the specified priority sectors identified by Australia. International PhD graduates from Australia in those sectors can also apply. This is an exciting new visa subclass and offers permanent residency.
