With the festive season almost upon us, shop trading hours for the 2011 Christmas/New Year period have been proclaimed, following consultation and agreement between the Shop, Distributive and Allied Employees’ Association (SDA), Business SA and the State Government.

Despite this agreement, shop trading hours are still dictated by the State Shop Trading Hours Act 1977 and are also affected by the Holidays Act 1910.

As the two pieces of legislation still stipulate the trading hours, businesses must apply for exemptions in order to trade on those days or times that are outside of the prescribed days and times, such as public holidays. A number of exemptions are already contained within the legislation, such as country areas.

The State Government has announced that the application process for exemptions has been simplified to help retailers take advantage of the extra trading hours on offer.

The following table outlines the days shops are to be closed, as well as trading hours for those businesses that exemptions have been granted.

Metropolitan Area

A full list of the areas included as metropolitan for the purposes of trading hours is available in the Shop Trading Hours Act 1977. However, please note that the metropolitan area also includes Gawler and the Adelaide Hills.

(Central Shopping District only)*

 

*The Monday 2 January 2012 applicable exemptions apply only to retailers within the Central Shopping District (CSD) and not the entire metropolitan area. Retailers outside of the CSD must be closed on this day. The Central Shopping District includes businesses around/within the Terraces in the city (North Terrace, South Terrace, West Terrace and East Terrace).

It should be noted that shopping centres may have different requirements for store owners and operators in terms of opening hours during this period.

Businesses need to ensure they are paying the correct penalty rates as prescribed in the relevant Modern Award and in accordance with the days listed in the above table.

Non-metropolitan Areas

Non-metropolitan areas must be closed on the following public holidays:

  • Sunday 25 December 2011
  • Monday 26 December 2011
  • Tuesday 27 December 2011
  • Monday 2 January 2012.


However, on days that are not public holidays, no restrictions apply and non-metropolitan retailers do not need to apply for any exemptions.
